Landmark judgement by Supreme Court on Gay Sex

Today is a red letter day for the Indian Judicial system. A five judge Constitutional Bench headed by the CJI Mr.Mishra handed down a Landmark judgement by decriminalizing consensual Gay sex. It is a great victory for the LGBT community who have been living in fear and fighting for their rights for years. This is probably only the beginning as this will lead to the opening up of more complex issues like same sex marriage, child adoption etc... Am sure the LGBT community will take up these cases in due course of time. One wishes that the Government of the day had taken up the cause of the LGBT in decriminalizing Gay sex instead of acting as a neutral observer and allowing the SC to decide.


The true acceptance of the LBBT community by the society is what will make the judgement very relevant. The age-old thought that Gay sex is abnormal and a mental disorder has been put to rest by the scientific community and the Judges have taken that into account while pronouncing their Judgement. Today is an important moment but the critics of the judgement believe that this will increase the incidence of HIV cases, as also increase in criminal acts of Paedophile .

As life moves forward, we have to think on statutes enacted long time back and see how to merge with times. Triple Talaq, equality of gender etc... are the cases where the world have brought changes and that's the way to move forward. For the society to accept might take time but what we have to do is to ensure children get the right message in the schools so that the coming generation view this as a normal aspect of life even if it happens to a miniscule segment of people.
